Mariner Taxes: State Income Tax and Unemployment

Originally published March 4, 2014 · Updated October 15, 2026

Where you work at sea, where you live, and where you claim unemployment are related facts, but they do not answer the same question. A vessel calling at a port does not by itself tell you which state should tax the wages or handle a claim.

State income tax on qualifying mariner pay

Federal law, 46 U.S.C. 11108, limits state income taxation of compensation for certain qualifying vessel duties. The protection depends on the vessel, the duties, and the applicable part of the statute. Residence remains important. Do not assume every job on or near the water qualifies, or that every state withholding entry on a W-2 is correct.

Bring your W-2s, residence history, employer information, and sailing records. We can review the tax treatment and identify what needs correction or further documentation.

Unemployment claims are a separate process

The state unemployment agencies decide where and how a claim should be filed and whether you meet their eligibility and work-search requirements. An income-tax rule does not automatically settle unemployment coverage. If you use a union hiring hall, ask the state agency how its work-search rules apply rather than assuming union membership creates an exemption.

What to report when benefits arrive

Unemployment compensation is generally included in federal taxable income. Keep Form 1099-G and records of any withholding. State income-tax treatment can differ. Tell us about benefits alongside your wages so we can review withholding and the full-year tax picture.

Before you file

Confirm claim questions with the relevant state agency. For tax preparation, see our mariner services or call (781) 471-4310. Explain your residence, employer, vessel duties, and the states involved.
